General provisions

The Competition is conducted in the form of a public promise of a competition prize within the meaning of Articles 919-921 of the Civil Code (hereinafter referred to as the "Competition").
These Regulations define the rules and conditions of participation in the Competition conducted under the name "Giveaway Hair Metamorphosis" organized via the social media platform Instagram and Facebook (hereinafter referred to as the "Website"), the method of informing about the Competition and its terms, the duration of the Competition, the rules for awarding prizes, the rules for announcing the results of the Competition, as well as the method of submitting complaints related to the Competition (hereinafter referred to as the "Regulations").
All materials published by the Organizer regarding the Regulations, regardless of form or location, are for informational purposes only. The Regulations are binding only.
The competition is not a promotional lottery within the meaning of Article 2, Section 1 of the Gambling Act of 19 November 2009 and is not subject to the rules contained in this Act or in the implementing regulations thereto.

The organizer of the competition is

Klaudia Duszyńska running a business under the name Hollywood Hair Klaudia Duszyńska at Peonii 20/10, 04-794 Warsaw NIP: 5060093284 REGON: 147365472, who has a profile on Instagram under the name Hollywoodhair_official and a profile on Facebook under the name Hollywood Hair (hereinafter referred to as the "Organizer").

The founder of the award is

Klaudia Duszyńska running a business under the name Hollywood Hair Klaudia Duszyńska at the address Peonii 20/10 NIP: 5060093284 REGON: 147365472, who has a profile on Instagram under the name @hollywoodhair_official and a profile on Facebook under the name Hollywood Hair (hereinafter referred to as the "Founder of the Prize").

on the Facebook platform under the name Hollywood Hair (hereinafter referred to as the "Organizer").

The competition is organized exclusively in the territory of the Republic of Poland on the Instagram and Facebook platforms.
The competition begins at the time of announcement and ends on December 19, 2025 at 4:59:59 PM. The time frame of the competition is defined for Polish time.
The aim of the competition is to select the best answer to the competition question from the comments.
The competition is organized in the field of winning a makeover consisting of hair extensions.

Platform owner disclaimer

The Organizer declares that the Competition is in no way organized, sponsored, conducted, supported, administered or endorsed by, or associated with, Instagram or Facebook.
The Participant agrees to release Instagram/Facebook from any liability that may arise in connection with the organisation of the Competition.
The entity solely responsible for conducting the Contest is the Participant. Participants acknowledge that participation in the Contest is contingent upon the release of the Website – Facebook and Instagram – from any liability that may arise in connection with the Contest. Any claims related to the Contest should be directed solely to the Organizer.

Conditions of participation in the Competition

Participation in the Competition is voluntary and free of charge.
Only a natural person who:
has read the Regulations;
is over 18 years of age, has full legal capacity and resides in the Republic of Poland;
has an active account on the Website;
has an active e-mail address;
will complete the Competition Task
releases the Website from any liability
(hereinafter referred to as the "Participant").

Only a person who meets the conditions specified in § 2, paragraphs 2 and 3 of the Regulations may participate in the Competition.
The Competition is not open to employees of the Organizer and persons cooperating with the Organizer on a permanent basis other than an employment relationship, as well as members of their immediate families, i.e. ascendants, descendants, siblings, spouses, parents of spouses and persons in an adoptive relationship with them.
The Organizer reserves the right to verify compliance with the Competition entry requirements. The Organizer reserves the right to exclude a Participant from participation in the Competition or refuse to award a Prize if it is determined that the Participant is acting in violation of these Rules or does not meet the conditions for participation in the Competition specified in these Rules, including, in particular, if the Participant is not acting on their own behalf but through a third party.

Sending a photo of the hair and a description of why the participant needs a hair makeover in Manychat automation

Participation in the Competition is entered by completing the competition task described in point 4, sub-point 1.
The Participant acknowledges that the Competition Entry must meet the following conditions:
be the result of the Participant's personal creativity;
it cannot contain vulgarisms, offensive or pornographic content, content promoting hatred or discrimination, in particular on racial, ethnic or religious grounds, contrary to applicable law, good customs and principles of social coexistence;
cannot ridicule the Organizer
it must not infringe the rights of third parties, including in particular copyrights, industrial property rights, image rights or third party property rights,
and the Participant must have exclusive and unlimited copyrights to the Competition Task,
is not encumbered with any third party rights and has not been previously published.
A Participant may take part in the Competition only 1 (in words: one) time.
The Participant may not transfer any rights or obligations related to participation in the Competition, including the right to the Prize, to third parties.

The course and results of the Competition

A post will be published on the Website containing information about the Competition, including in particular information about the rules and prizes in the Competition.
The Organizer ensures the proper conduct of the Competition, including the right to make all decisions related to the Competition, to evaluate the Competition Entries both in terms of form and substance, and to independently select the Prize Winner.
To ensure the proper conduct of the Competition, the Organizer will appoint a two-person Committee (hereinafter referred to as the "Competition Committee"), whose tasks will include:
ensuring the proper conduct of the Competition,
making decisions on all matters related to the Competition,
evaluation of the Competition Entries in terms of both formal and substantive aspects
selecting the Competition Winner(s),
Taking other actions related to the Competition.

The Organizer's decisions are final, which, however, does not deprive the Participant of the right to pursue claims arising from legal provisions.
After the deadline for submitting Competition Entries, the Competition Organizer will evaluate the Competition Entries and select from among them 1 (one) Competition entry with the best substantive content.
The Contest results will be announced on December 19, 2025, by 6:00 PM on Instagram via private message and by posting the username on Instagram stories.
The winner of the Competition will be notified of their win via private message via Instagram and the list of winners will be published on the @hollywoodhair_official profile on Instagram stories.

Awards
The prize in the Competition is a complete makeover with hair extensions at the Hollywood Hair salon in Warsaw.

The prize cannot be exchanged for its cash equivalent or for any other benefit or prize in kind. The Organizer will select the weight and length of hair to be used for the transformation.

Pursuant to Article 21, Section 68 of the Personal Income Tax Act, the Organizer is exempt from the obligation to collect and pay to the appropriate tax office the flat-rate income tax on the value of the prizes.

The condition for receiving the Prize is that the Winner(s) provide by e-mail within 7 (seven) days from the date of announcing the Winner the information necessary to deliver the Prize, including in particular: name, surname, e-mail address, telephone number, PESEL number and mailing address.
The Prize will be sent at the Organizer’s expense within 7 (seven) days from the date of announcement of the Competition results by the Prize Sponsor to the correspondence address exclusively within the territory of the Republic of Poland indicated by the Winner.
The Organizer is not responsible for the inability to deliver the Prize due to reasons attributable to the Winner.

Personal data

The controller of the Participants’ personal data within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as the “GDPR”) is the Organizer.
The information clause constitutes Annex 1 to the Regulations.

License

The Organizer reserves the right, upon issuing the Prize, to acquire a non-exclusive license to the awarded Competition Task without time and territorial restrictions, and the awarded Winner will grant the Organizer a non-exclusive license to the awarded Competition Task in all fields of exploitation, including in particular paragraph 3 below:
The Organizer and each Competition Winner will sign an appropriate license agreement under the terms specified in point VIII of the Regulations ("License").
Upon issuance of the Prize, each Winner grants the Organizer a non-exclusive license to the awarded Competition Task in all fields of exploitation, including in particular:
in the scope of recording and reproduction of the Competition Task - producing copies of the work using a specific technique, including printing, reprographic, magnetic recording and digital techniques;
in the scope of trading in the original or copies on which the Competition Task was recorded - introducing into circulation, lending or renting the original or copies;
within the scope of disseminating the work in a manner other than specified in points a and b - public performance, exhibition, display, reproduction, broadcasting and rebroadcasting, as well as making the work publicly available in such a way that everyone can have access to it at a place and time of their choice, including entering the work into computer memory and telecommunications and IT networks, including via the Internet and paid websites,
for the Prize won in the Competition specified in point VI sub-point 1 of these Regulations.

For the avoidance of doubt, the Prize in this Competition constitutes the sole remuneration for the license granted.
In matters not regulated in this point, the relevant provisions of the Civil Code and the Copyright and Related Rights Act will apply to this agreement.

Complaint procedure

Any complaints regarding the Competition may be submitted via email to reklamacje@hollywoodhair.pl no later than 14 (fourteen) days from the date the Competition results are announced. Complaints submitted after this deadline will not be considered.
The complaint should include: name, surname, e-mail address and description, reason and justification of the complaint.
Complaints will be resolved within 14 days from the date of receipt of the complaint.
The Participant will be notified about the consideration of the complaint in writing to the address indicated in the complaint or via e-mail provided by the Participant.

Final provisions

The regulations are available on the website www.hollywoodhair.pl
These Terms and Conditions are governed exclusively by Polish law. In matters not regulated herein, generally applicable provisions of Polish law, in particular the Civil Code, shall apply.
The Organizer reserves the right to change the Regulations to the fullest extent permitted by law, provided that this does not affect the right to a Prize already acquired by the Winner.

Purposes and legal basis for processing personal data
Personal data will be processed, in accordance with the provisions of the GDPR, in writing or electronically, for the following purposes:

pursuant to Article 6 paragraph 1 letter a of the GDPR in relation to each Winner for the purpose of publishing the Competition results;
pursuant to Article 6(1)(c) of the GDPR in order to ensure accountability and demonstrate compliance with the obligations imposed on the Controller, including maintaining a register of personal data processing and maintaining other accounting and bookkeeping documentation;
pursuant to Article 6 paragraph 1 letter f of the GDPR - the legitimate interest of the Organiser in conducting the Competition, selecting the Winner, issuing the Prize, considering any complaints, and in the case of the Winner, additionally in order to notify the winner of the win, pay the income tax due and issue the Prize.
pursuant to Article 6(1)(f) of the GDPR for the purposes of the Controller's legitimate interest in establishing, pursuing or defending against claims and for the purpose of conducting promotional and marketing activities related to the activities conducted by the Controller.
