REGULATIONS OF THE COMPETITION "WIN A METAMORPHOSIS FOR YOUR GRANDMOTHER"

  1. COMPETITION REGULATIONS "Win a metamorphosis for your grandmother"

    1. General provisions _
    1. The competition is conducted in the form of a public promise of a competition prize within the meaning of Art. 919-921 of the Civil Code (hereinafter referred to as the "Competition").
    2. These Regulations specify the rules and conditions of participation in the Competition conducted under the name " Win a makeover for your grandmother " organized via the Instagram and Facebook social media platforms (hereinafter referred to as the "Website"), the method of informing about the Competition and its conditions, the duration of the Competition, and the rules for awarding the prize. , rules for announcing the results of the Competition, as well as the method of submitting complaints related to the Competition (hereinafter referred to as the "Regulations").
    3. All materials published by the Organizer regarding the Regulations, regardless of the form and place of publication, are for information purposes only. The Regulations are exclusively binding.
    4. The competition is not a promotional lottery within the meaning of Art. 2 section 1 of the Act of November 19, 2009 on gambling and is not subject to the rules contained in this Act or in the implementing regulations to this Act.

     

    • Registration for a competition in which only the Promiser participates

    1. The organizer of the competition is

     

    Klaudia Duszyńska runs a business under the name Hollywood Hair at Peonia 20/10 NIP: 5060093284 REGON: 147365472, who has a profile on Instagram under the name @hollywoodhair_official and a profile on the Facebook platform under the name Hollywood Hair (hereinafter referred to as " Organizer").

    1. The Organizer makes a public promise of the competition prize specified in these Regulations.

    1. The competition is organized only in the territory of the Republic of Poland on the Instagram and Facebook platforms.
    2. The competition starts at the time of announcement and ends on February 2024 at 23:59:59. The time frame of the Competition is set for Polish time.
    3. The aim of the competition is to select the best answer, according to the jury, to the question why your grandmother should win a Hollywood Hair makeover.
    4. The competition is organized in the field of hair thickening or extension services.

     

    1. Exclusion of liability of the platform owner

     

    1. The Organizer/Promiser declares that the Competition is in no way organized, sponsored, conducted, supported, administered or endorsed by Instagram and Facebook or associated with them.
    2. The Participant agrees to release Instagram/Facebook from any liability that may arise in connection with the organization of the Competition.
    3. The entity solely responsible for conducting the Competition is the Participant acknowledges that the condition for participating in the Competition is to release the Website - Facebook and Instagram - from any liability that may arise in connection with the organized Competition. Any claims related to the Competition should be directed solely to the Organizer.

    • Conditions of participation in the Competition

    1. Participation in the Competition is voluntary and free of charge.
    2. Only an individual who:
      1. has read the Regulations;
      2. is over 18 years of age, has full legal capacity and resides in the Republic of Poland;
      3. has an active public account on the Website;
      4. has an active e-mail address;
      5. will complete the Competition Task
      6. releases the Website from any liability

    (hereinafter referred to as the "Participant").

    1. Only a person who meets the conditions specified in § 2 section. may participate in the Competition. 2 and 3 of the Regulations.
    2. The Organizer's employees and persons cooperating with the Organizer on a permanent basis other than an employment relationship, as well as members of their immediate families, i.e. ascendants, descendants, siblings, spouses, parents of the spouses and persons in an adoption relationship with the Organizer, cannot participate in the Competition. .
    3. The Organizer has the right to verify compliance with the conditions for participation in the Competition. The Organizer is entitled to exclude the Participant from participation in the Competition or refuse to award the Prize if it turns out that the Participant is acting contrary to the Regulations or does not meet the conditions for participation in the Competition specified in the Regulations, in particular the Participant is not acting on his/her own behalf, but by third parties.

    1. Competition task

    1. The competition task is to send a photo of your grandmother and answer the question why your grandmother should win a makeover at Hollywood Hair ("Competition Entry").
    2. Participation in the Competition is entered by sending a message and completing the task
    3. The Participant acknowledges that the Competition Entry should meet the following conditions:
    4. be the result of the Participant's personal creativity;
    5. may not contain vulgarisms, offensive or pornographic content, content promoting hatred or discrimination, in particular on racial, ethnic or religious grounds, contrary to applicable law, good customs and principles of social coexistence;
    6. must not ridicule the Organizer and must not violate the rights of third parties, in particular copyrights, industrial property rights, image rights or property rights of third parties,
    7. and the Participant must have exclusive and unlimited copyrights to the Competition Task,
    8. is not encumbered with any third party rights and has not been published before.
    9. The Participant may take part in the Competition only 1 (in words: one) time.
    10. The Participant may not transfer the rights or obligations related to participation in the Competition, including the right to the Prize, to third parties.

     

    1. The course and results of the Competition

    1. A post will be posted on the Website with information about the Competition, including in particular information about the rules and prizes in the Competition.
    2. The Organizer/Promisor ensures the proper conduct of the Competition, including the right to make all decisions related to the Competition, evaluate the Competition Entries both formally and substantively, and to independently select the Prize Winner.
    3. To ensure the correct conduct of the Competition, the Organizer will appoint a two-person Commission (hereinafter referred to as the "Competition Commission"), whose tasks will include:
      1. ensuring the proper conduct of the Competition,
      2. making decisions on all matters related to the Competition,
      3. assessing the Competition Entries both formally and substantively
      4. selecting the Competition Winner(s),
      5. Taking other activities related to the Competition.
    4. The decisions of the Organizer of the Competition Committee are final, which, however, does not deprive the Participant of the right to pursue claims arising from legal provisions.
    5. After the deadline for sending Competition Entries has expired, the Organizer's Competition Committee will evaluate the Competition Entries and select from among them 1 (one) best-performed Competition Entry in terms of content.
    6. The results of the Competition will be announced on January 26, 2024 by 7:00 p.m. on the website via Instagram
    7. The winner of the competition will be notified of the win by private message.

    1. Awards

     

    1. The prize in the competition is a metamorphosis, i.e. extension or thickening of the participant's grandmother's hair.

    1. The prize cannot be exchanged for its cash equivalent or exchanged for any other benefit or other prize in kind. The transformation can only take place at the Hollywood Hair salon located at 44 Belwederska Street in Warsaw. Hollywood Hair stylists will decide on the final effect of the metamorphosis, i.e. the amount of weight and length.
    2. In accordance with the Personal Income Tax Act, the organizer is responsible for collecting and remitting to the appropriate tax office a flat-rate income tax on the value of prizes in the amount of 10%.
    3. The Organizer grants the Winners an additional prize in the form of a cash prize in the amount corresponding to the personal income tax for winning the Competition, calculated on the grossed up by the due income tax value of prizes in kind. The cash prize is not payable to the winner, but is used only to finance the income tax due on the value of the prize charged to the winners ("gross-up of the prize") in accordance with the Personal Income Tax Act.
    4. The Organizer will fulfill the obligation to send an annual declaration (PIT-8AR) to the competent tax office by the end of January of the year following the tax year in which the prizes were issued.

     

    1. The condition for receiving the Prize is that the Winner(s) provide via e-mail within 7 (seven) days from the date of announcement of the Winner the information necessary to deliver the prize, including in particular: name, surname, e-mail address, telephone number, PESEL and correspondence address.
    2. The Prize will be paid at the Organizer's expense within 30 (thirty) days from the date of announcement of the Competition results by the Prize Founder to the correspondence address only in the Republic of Poland indicated by the Winner.
    3. The Organizer is not responsible for the inability to transfer the Prize for reasons attributable to the Winner.

    • Personal data

    1. The administrator of the Participants' personal data within the meaning of the Regulation of the European Parliament and of the Council EU 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Regulation on Data Protection) (hereinafter referred to as "GDPR") is the Organizer.
    2. The information clause constitutes Annex 1 to the Regulations.

    • License

     

    1. The Organizer reserves the right, upon issuing the Prize, to acquire a non-exclusive license to the awarded Competition Task without time and territorial limits, and the awarded Winner will grant the Organizer a non-exclusive license to the awarded Competition Task in all fields of exploitation, including in particular section 3 below:
    2. The Organizer and each Competition Winner will sign an appropriate license agreement under the terms specified in point VIII of the Regulations ("License").
    3. Upon issuing the Prize, each Winner will grant the Organizer a non-exclusive license to the awarded Competition Task in all fields of exploitation, including in particular :
      1. in the scope of recording and reproducing the Competition Task - producing copies of the work using a specific technique, including printing, reprographic, magnetic recording and digital techniques;
      2. in the scope of trading the original or copies on which the Competition Task was recorded - placing on the market, lending or renting the original or copies;
      3. in the scope of disseminating the work in a manner other than that specified in point a and b - public performance, exhibition, display, reproduction, broadcasting and rebroadcasting, as well as making the work publicly available in such a way that everyone can have access to it at a place and time of their choosing, including entering the work into computer memory and into telecommunications and IT networks, including via the Internet and paid websites,

    for the Prize won in the Competition specified in point VI, point 1 of these Regulations.

    1. For the avoidance of doubt, the Prize in this Competition constitutes the only remuneration for the license granted.
    2. In matters not regulated in this point, the relevant provisions of the Civil Code and the Act on Copyright and Related Rights will apply to the contract in question.

     

    1. Complaint procedure

    1. All complaints regarding the Competition may be submitted via e-mail to the following address: reklamacje@hollywoodhair.pl no later than 14 (fourteen) days from the date of announcement of the Competition results. Complaints submitted after the specified deadline will not be considered.
    2. The complaint should include: name, surname, e-mail address and a description, reason and justification of the complaint.
    3. Complaints will be resolved within 14 days from the date of receipt of the complaint.
    4. The Participant will be notified about the consideration of the complaint in writing to the address indicated in the complaint or via e-mail indicated by the Participant.

     

    1. Final Provisions

    1. The regulations are available on the website www.hollywoodhair.pl
    2. The Regulations are subject exclusively to Polish law. In matters not regulated in the Regulations, generally applicable provisions of Polish law shall apply, in particular the provisions of the Civil Code.
    3. The Organizer reserves the right to change the Regulations to the fullest extent permitted by law, to the extent that it will not affect the right to the Prize already acquired by the Winner.

    Annex No. 1 - Information clause regarding the processing of personal data of Competition Participants

    In connection with the content of art. 13 section 1 and section 2 Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons in relation to
    with the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (GDPR for short ) , I inform you about the following principles of personal data processing:

    • Purposes and legal basis for the processing of personal data

    Personal data will be processed, in accordance with the provisions of the GDPR, in writing or electronically, for the following purposes:

    1. based on Article. 6 section 1 letter a GDPR in relation to each Winner in order to publish the results of the Competition;
    2. based on Article. 6 section 1 letter c GDPR in order to ensure accountability and demonstrate compliance with the obligations imposed on the Administrator, including maintaining a register of personal data processing and maintaining other accounting and bookkeeping documentation;
    3. based on Article. 6 section 1 letter f GDPR - the legitimate interest of the Organizer in order to conduct the Competition, select the Winner, issue the Prize, consider any complaint, and in the case of the Winner, additionally to notify about the win, pay the due income tax and issue the Prize.
    4. based on Article. 6 section 1 letter f GDPR for the legitimate interest of the Administrator in the form of establishing, investigating or defending against claims and for the purpose of conducting promotional and marketing activities related to the activities conducted by the Administrator.

     

    1. Data recipients
    2. In connection with data processing, personal data may be made available to the following recipients or categories of recipients :

    4. Entities supporting the Administrator's business activities, in particular :

    1. Transferring personal data to a Third Country or International Organization

     

    1. Your data will not be processed outside the EEA.
    2. The Administrator informs that it transfers personal data outside the EEA only when necessary
      and ensuring an adequate level of protection, primarily through:
    3. Cooperation with entities processing personal data in countries for which an appropriate decision of the European Commission has been issued regarding the assurance of an adequate level of personal data protection.
    4. The use of standard contractual clauses (so-called Standard Contractual Clauses) approved by the European Commission.
    5. The administrator may use automated decision-making, including profiling, for marketing purposes and to adapt the offer to customer needs.

     

    1. Your data will not be subject to automated decision-making, including profiling.

     

    1. The data administrator cannot entrust data processing to another entity
      by way of an agreement concluded in writing.

     

    1. Personal data storage period

     

    Personal data will be stored for the duration of the Competition and then until the complaint procedures are completed, in the event of:

    1. Winners - for the period of storage of tax documentation, but no longer than for a period of 5 (five ) years counted from the end of the calendar year in which the Competition was held;
    2. other Participants for a period of 6 (in words: six) months counted from the date of completion of the results in the Competition.

    If your personal data are to be used for a purpose other than the one for which they were transferred or collected, the Administrator will inform you about this purpose and provide all information required by law.

    • Voluntary provision of personal data

    The processing of the Winner's personal data in terms of consent to the publication of his personal data is voluntary. The winner has the right to withdraw consent at any time. However, this will not affect the processing of personal data that was carried out before the consent was withdrawn.

     

    • Rights related to the processing of personal data:

    In connection with the processing of personal data, you have the following rights:

    1. If the legal basis for processing is Art. 6 section 1 letter a or b GDPR:
    2. the right to access the data content;
    3. the right to request rectification of data;
    4. the right to restrict data processing;
    5. the right to transfer data.

    6. The right to delete data (right to be forgotten).

    If the processing is based on your consent, we will process the data until it is withdrawn. Consent may be withdrawn at any time by sending a message via e-mail to the following address: reklamacje@hollywoodhair.pl or in writing to the address of the Administrator's registered office. Withdrawal of consent does not affect the lawfulness of processing carried out on the basis of consent before its withdrawal.

     

    1. The right to lodge a complaint with the supervisory authority.

    If you find a violation on the part of the Administrator regarding the security of personal data processing, you have the right to lodge a complaint with the President of the Office for Personal Data Protection, ul. Stawki 2, 00-193 Warsaw.

     

    1. Automated decision-making, including profiling
    2. The administrator may use automated decision-making, including profiling, for marketing purposes and to adapt the offer to customer needs.
